Legal Bases for Processing (EEA/UK Users)

If you are in the European Economic Area or the United Kingdom, we process your personal information under the following legal bases:

  • Performance of a contract: to create and manage your account, process payments, and provide the core Service, including storing and processing the creative content and AI interactions you submit.
  • Legitimate interests: to operate, secure, analyze, and improve the Service — including in-product usage analytics (see Section 8.2) and fraud prevention — where these interests are not overridden by your rights.
  • Consent: for analytics cookies on our marketing website (see Section 8.1), and for any other processing where we ask for your consent. You may withdraw consent at any time.
  • Legal obligation: where processing is necessary to comply with applicable law.

Where we rely on legitimate interests, you have the right to object (see Section 7).

4. Information Sharing and Disclosure

We do not sell, trade, or rent your personal information to third parties. We also do not “sell” or “share” your personal information for cross-context behavioral advertising or targeted advertising as those terms are defined under applicable U.S. state privacy laws (such as the CCPA), and have not done so. We may share your information in the following circumstances:

4.1 Service Providers

We may share information with trusted third-party service providers who assist us in operating our Service, such as cloud hosting providers, payment processors, analytics services, and AI model providers.

4.2 Legal Requirements

We may disclose information if required by law, court order, or government request, or to protect our rights, property, or safety, or that of our users or the public.

4.3 Business Transfers

In the event of a merger, acquisition, or sale of assets, your information may be transferred as part of the transaction.

4.4 Consent

We may share information with your explicit consent or at your direction.

5. Data Security

We implement appropriate technical and organizational security measures to protect your personal information against unauthorized access, alteration, disclosure, or destruction. These measures include:

  • Encryption of data in transit and at rest
  • Regular security assessments and updates
  • Access controls and authentication mechanisms
  • Secure data centers and infrastructure
  • Employee training on data protection practices

However, no method of transmission over the internet or electronic storage is 100% secure. While we strive to protect your information, we cannot guarantee absolute security.

6. Data Retention

We retain your personal information for as long as necessary to provide our Service and fulfill the purposes outlined in this Privacy Policy, unless a longer retention period is required or permitted by law.

When you delete your account, we will delete or anonymize your personal information within 30 days, except for information we are required to retain for legal, security, or business purposes.

7. Your Rights and Choices

Depending on your location, you may have rights under applicable privacy laws (including GDPR and CCPA) regarding your personal information:

  • Access, correction, deletion, or restriction of processing
  • Data portability
  • Object to certain types of processing
  • Withdraw consent where processing is based on consent

To exercise these rights, contact us at the addresses listed below.

If you are located in the European Economic Area or the United Kingdom, you also have the right to lodge a complaint with your local data protection supervisory authority.

8. Cookies and Analytics Technologies

8.1 Marketing Website

On our public marketing website we use Google Analytics only after you allow analytics tracking in the analytics consent banner. With your consent, Google Analytics may store or access analytics identifiers on your device. Analytics tracking helps us measure aggregate traffic, understand acquisition channels, and improve the public website.

We do not use analytics consent for personalized ads, ad storage, social sharing, or location-based advertising. You can change your analytics preference at any time.

8.2 In-Product Analytics

Inside the signed-in application we use PostHog (provided by PostHog, Inc.), hosted in the European Union, to understand how the product is used — for example which features are used and where users run into friction — so we can improve it.

This in-product analytics is cookieless: PostHog is configured to keep its state in memory only and doesnot place cookies or write persistent identifiers on your device. Because nothing is stored on or read from your device for this purpose, it does not require a separate consent banner.

We collect product-usage events such as pages viewed, features used, and actions taken, along with technical data such as your IP address, approximate location, browser, and device type. Once you are signed in, these events are associated with your account. We do not send your creative content — your novels, chapters, characters, prompts, or AI outputs — to PostHog; these events carry only identifiers, counts, and categories.

We rely on our legitimate interest in operating, securing, and improving the Service as the legal basis for this processing. You may object to it at any time: we honor browser-based “Do Not Track” / Global Privacy Control signals, and you may also contact us using the details in Section 14. See Section 7 for your rights, including the right to object.

8.3 Session Replay

We may use session replay technology to record how you interact with the application — such as navigation, clicks, scrolling, and similar interactions — to diagnose issues, understand usage, and improve the Service. Where session replay is enabled, we mask sensitive inputs and the text content of your creative work, so that your novels, chapters, and other writing are not captured. We rely on our legitimate interest for this processing; you may object using the methods in this Section and in Section 7.

9. Third-Party Services

Our Service may link to third-party websites or integrate with third-party services. This Privacy Policy does not apply to those third parties. Review their privacy policies before use.

10. International Data Transfers

Your information may be transferred to and processed in countries outside your residence. We ensure appropriate safeguards in accordance with applicable laws.

11. Children's Privacy

Our Service is not intended for children under 13 in the US or under 16 in the EU. We do not knowingly collect information from children under these ages.

12. Changes to This Privacy Policy

We may update this Privacy Policy periodically. Material changes will be posted on this page with the updated date.

13. Governing Law

This Privacy Policy is governed by the laws of the State of Delaware, USA. Any disputes shall be resolved in the courts located in Delaware.
